What are Contingency Fees?
Most contracts for professional representation regarding personal injury claims are in the form of “contingency fee” contracts. The Florida Supreme Court recognizes that most people who are injured as a result of someone else’s negligence simply cannot afford the substantial cost of representation and pursuing a legal claim for damages. Accordingly, it is proper for a lawyer to represent people who are the victims of negligence based on being paid a percentage of any recovery made. And while it is not permissible to lend a client money (lawyers must avoid even the appearance of impropriety), lawyers are entitled to “front” or advance the costs of pursuing such claims.
